OVERVIEW
Welcome to Delgrappo (“we”, “us”, “our”). We operate this online store and website, including related content, features, tools, products and services (the “Services”), to offer you a curated shopping experience. Our store is hosted on Shopify, which provides the e-commerce platform that enables us to sell our products to you.
These Terms of Service (“Terms”) govern your access to and use of the Services. They incorporate by reference our Privacy Policy, Cookie Policy and Refund & Returns Policy (collectively, the “Policies”). By visiting, interacting with or using the Services, you agree to be bound by these Terms and the Policies. If you do not agree, please do not use the Services.
ACCESS, ELIGIBILITY & ACCOUNT
Age & capacity. By using the Services, you confirm you are at least the age of majority in your country of residence and have the capacity to enter into a binding agreement. If you allow minors to use devices you own or manage to access the Services, you are responsible for their use.
Accurate information. You must provide current, complete and accurate information (e.g., email, billing, payment and shipping details) and keep it up to date.
Account security. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Do not share, assign or transfer your account.
OUR PRODUCTS & PRESENTATION
Product depiction. We strive to display products accurately; however, colours and finishes may vary due to device settings and displays.
Changes. Descriptions, specifications and availability may change without notice. We may limit quantities or discontinue items at our discretion.
Craft & variation. Minor variations typical of manufacturing and materials may occur and do not necessarily constitute a lack of conformity.
ORDERS & CONTRACT FORMATION
Offer & acceptance. When you place an order, you make an offer to purchase. A contract is formed only when we confirm acceptance (e.g., order confirmation email). If we cannot accept or must cancel your order (e.g., stock, payment checks, pricing errors), we will notify you and issue any refund due.
Review before submitting. Please review carefully; cancellation requests may not be possible after acceptance.
Personal use. You confirm purchases are for personal/household use and not for commercial resale or export.
PRICES, TAXES & BILLING
Displayed prices. Prices shown at checkout are those in effect at the time of ordering. Unless stated otherwise, prices exclude shipping/handling and any applicable customs or import charges.
VAT. Where applicable, prices include VAT in accordance with Irish/EU rules.
Promotions. Promotions may be subject to separate terms; in case of conflict, promotional terms prevail.
Payment details. You authorise us (or our processors) to charge your selected payment method for the full amount due and represent that you are authorised to use it.
UK customers are subject to IVA and import duties upon customs clearance.
SHIPPING, DELIVERY & RISK
Dispatch estimates. Delivery dates are estimates, not guarantees; delays may occur (e.g., carrier issues, customs).
Risk & title (EU consumer rule). For consumer purchases, risk of loss passes to you only upon delivery to you or your designee (unless you arranged your own carrier without using our shipping options). Title passes upon full payment.
Customs. For deliveries outside the EU/EEA, you are responsible for customs duties, taxes and fees upon import.
UK customers are subject to VAT and import duties upon customs clearance.
RIGHT OF WITHDRAWAL (EU/EEA CONSUMERS)
14-day cooling-off. If you are an EU/EEA consumer, you have the right to withdraw from your distance purchase within 14 days from delivery, in accordance with the EU Consumer Rights Directive and Irish law.
How to exercise. Inform us within 14 days (email below) and return the goods within the statutory timeframe. You may use any clear statement; we will acknowledge receipt.
Condition & refunds. Items must be returned unused and in resalable condition with original packaging/accessories. We will refund the price (including standard delivery costs, if charged) without undue delay and no later than 14 days from the day we receive the goods or acceptable proof of return.
Return costs. Unless stated otherwise or the item is defective or non-conforming, you bear the direct cost of return.
Exclusions. The right of withdrawal does not apply to sealed goods not suitable for return once unsealed for health or hygiene reasons, customised/personalised items, or other statutory exceptions. Your statutory rights remain unaffected. See our Refund & Returns Policy for operational details.
WARRANTY, COVERAGE AND CONDITIONS
All watches sold by Delgrappo are covered by a 2 years warranty from the date of purchase, guaranteeing that they conform to the description provided at the time of sale and are free from defects.
This warranty does not apply to normal wear and tear resulting from regular use. Any water related damage will be examined to determine whether it results from improper handling of the product or from a manufacturing defect.
To submit a warranty request, the customer must contact Customer Service as soon as the issue is identified by emailing support@delgrappo.com with a clear and complete description of the defect so that an appropriate assessment can be carried out.
INTELLECTUAL PROPERTY
All trademarks, trade names, logos, designs, text, images, graphics, video, audio, software and their arrangement on the Services are owned by Delgrappo or licensors and protected by applicable IP laws. Use is limited to personal, non-commercial purposes. Any reproduction, distribution, modification or derivative use requires prior written consent. All rights not expressly granted are reserved.
OPTIONAL TOOLS & THIRD-PARTY LINKS
Tools. Access to third-party tools is provided “as is” and “as available” without warranties or endorsements. Your use is at your discretion and subject to the third party’s terms.
Links. The Services may link to third-party sites. We are not responsible for their content, policies or practices. Review their terms and privacy policies before engaging.
RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. Sales are made directly between you and Delgrappo. Shopify is not a party to your purchase and is not responsible for your order, products or related claims. You expressly release Shopify and its affiliates from claims arising from your transactions with Delgrappo.
PRIVACY & COOKIES
Your personal data is processed in accordance with our Privacy Policy and Cookie Policy (including consent requirements). Because we are hosted by Shopify, certain data may be processed by Shopify and other providers to operate and improve the Services, which may involve international transfers with appropriate safeguards (e.g., EU Standard Contractual Clauses).
USER CONTENT & FEEDBACK
If you share reviews, images, ideas or other content (“Feedback”), you grant Delgrappo a worldwide, royalty-free, sublicensable and transferable licence to use, reproduce, display, distribute and create derivative works for operating, improving and promoting the Services. You represent that you have the necessary rights, that your content is accurate and lawful, and that it does not infringe third-party rights. We may moderate or remove content where unlawful or contrary to these Terms.
ACCEPTABLE USE
You agree not to misuse the Services, including by breaking laws; infringing IP; harassing or defaming others; transmitting malware; attempting unauthorised access; scraping; or interfering with security or operation. We may suspend or terminate access where we reasonably believe these Terms have been breached.
ERRORS & AVAILABILITY
We endeavour to ensure accuracy, but typographical errors, inaccuracies or omissions may occur (e.g., pricing, availability, shipping times). We may correct or update information and cancel orders where necessary, with appropriate refunds where applicable.
WARRANTIES — DISCLAIMER (SUBJECT TO CONSUMER LAW)
Except as required by law or expressly stated by us, the Services and products are provided on an “as is” and “as available” basis, without warranties of any kind (express or implied). Nothing in this clause limits your statutory consumer rights, including the EU legal guarantee of conformity.
LIMITATION OF LIABILITY (SUBJECT TO CONSUMER LAW)
To the maximum extent permitted by law, Delgrappo and its directors, employees and service providers shall not be liable for indirect or consequential losses (e.g., loss of profits, data or business), except where liability cannot be excluded under applicable law. We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Your statutory consumer rights remain unaffected.
INDEMNITY
To the extent permitted by law, you agree to indemnify and hold harmless Delgrappo from third-party claims arising out of your unlawful use of the Services or breach of these Terms. This clause does not require consumers to indemnify Delgrappo for matters caused by our own fault.
CHANGES TO SERVICES OR TERMS
We may update or modify the Services and these Terms from time to time. Material changes will be notified in accordance with applicable law and will take effect on the date specified in the notice. Your continued use after changes become effective constitutes acceptance.
ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganisation or sale of assets, provided this does not reduce your statutory rights.
SEVERABILITY & WAIVER
If any provision of these Terms is found unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will continue in full force. Our failure to enforce any provision is not a waiver of our rights.
GOVERNING LAW, JURISDICTION & ODR
These Terms and any non-contractual obligations are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction, without prejudice to mandatory consumer protections and the right of consumers to bring proceedings in their country of residence within the EEA.
